Tyler Robinson Trial Date Still Unset After Utah Hearing

ReTyler Robinson Trial Date Still Unset After Utah Hearing

A Utah judge did not set a trial date for Tyler Robinson, the man accused of killing Charlie Kirk, after both sides argued over timing. Erika Kirk's attorney urged the court to move faster.

A Utah judge did not set a trial date on Tuesday for Tyler Robinson, the 23-year-old accused of assassinating Charlie Kirk at a Turning Point USA event last year, after a hearing in Provo in which prosecutors, the defense and an attorney for Kirk's widow each presented their timelines. Judge Tony Graf Jr. said he had planned to set a date at the end of the roughly three-hour proceeding but needed more time after questioning both sides about their schedules and commitments in other trials.

Robinson, wearing a light gray suit and appearing uncuffed and unshackled, did not address the court. He spoke quietly with his attorneys, Richard Novak, Kathy Nester and Staci Visser, during breaks, and at one point handed Visser a note. Several interruptions were caused by technical difficulties with the WebEx connection, with defense attorney Michael Burt and an attorney for Kirk's parents, Robert and Kathy, participating remotely. Robinson did not enter a plea until last month, nearly a year after he was charged.

Jeffrey Neiman, an attorney for Erika Kirk, the widow of Charlie Kirk, pressed the court to speed the case along. "Every day of delay adds to uncertainty, invites speculation and that erodes confidence in this system," Neiman told the judge. He noted that only about 5% of federal cases reach trial and said the Kirk family would be willing to write to a federal judge to ask that a conflicting January trial be rescheduled. Neiman also argued that under Utah's state constitution, victims and their representatives have a right to a speedy resolution, and Erika Kirk is the court's designated victim's representative. "Justice delayed this long stops being justice for the Kirk family," he said. He added that "time is the defense's best ally" and that regardless of when the trial takes place, Charlie Kirk would not be able to spend Christmas with his family. "Your honor, if you set it, it will happen," Neiman said. "Set it, please."

Utah County prosecutors proposed January 31, 2028, as their preferred start date but said they could be ready as early as October 2027. Visser argued that the state's proposed January 2028 date was "not practical," citing more than 31,000 pieces of discovery and "8 million" artifacts of digital evidence. She said pretrial litigation "builds upon itself," and that lawyers would need time to file motions to compel and subpoenas. "Discovery review is foundational," she said. "It impacts everything else."

The defense asked for a "soft target" date in the third quarter of 2029. Among the scheduling conflicts cited was a federal racketeering case that defense attorney Novak has set for January 10, 2028, which overlaps with the prosecution's desired start. Both sides agreed that a trial running through the holidays could place potential jurors and witnesses in a difficult position. Novak told the court the trial date should not be rushed, arguing that "the reality is rushing to trial does not lead to closure. It does not lead to finality. It leads to mistakes."

Graf said he was concerned that if a date was not set soon, further conflicts could arise. He scheduled the next hearing for Monday, November 9, at 1 p.m. Mountain Time, when he said he would read his ruling on the timing question. Until then, no trial date has been set in a case that has drawn wide public attention since Kirk's killing.
